Act for Obtaining a Charter
of the Graduate and Professional Student Government
of the University of North Carolina at Charlotte

PURPOSE OF OBTAINING
The purpose of this Act is to set forth
the rights and obligations associated with a Graduate and Professional
Student Senate grant of a charter to a student organization, including
the application for such a grant. The grant of a charter to a graduate
student organization confers those rights, enumerated in the “Act for
Obtaining a Charter.”

| Section 1 |
Obtaining a Charter
1. Graduate student organizations
must be constituted by a minimum of the three (3) required officers, be
academic or professional in nature and be open to all interested
students in good standing at the University of North Carolina at
Charlotte. Each organization shall have at all times 100% UNC Charlotte
student constituency.
2. Any graduate student group who show less than 80% graduate student
membership must be chartered through the Student Government Association
(SGA).
3. The graduate student organization will abide by all applicable
requirements of State and Federal laws and local ordinances; by all
University of North Carolina and University of North Carolina at
Charlotte policies, rules, and regulations, including but not limited to
The Code of Student Responsibility; and by all applicable requirements
imposed under the authority of the Graduate and Professional Student
Senate, including but not limited to the “act for Obtaining a Charter”
as appropriate.
4. The organization will include in its constitution a clause stating
that it will not discriminate, in its membership policies or otherwise,
against any person on the basis of race, color, national origin, sex,
sexual orientation, age, religion or disability.
5. The organization will at all times have an official advisor who is a
current member of the faculty or the staff of the University of North
Carolina at Charlotte.
6. The organization will elect at least the following officers:
President, Vice-President, Secretary, and Treasurer. The offices of
Secretary and Treasurer may be held by the same person. The President
will provide the names, addresses, and telephone numbers of each officer
and the student identification number of the President and Treasurer, in
writing to the GPSG Secretary within fifteen (15) calendar days after
the first day of classes in each of the fall and spring semesters, and
will advise the GPSG Secretary in writing of the names, student
identification numbers of the President and Treasurer, addresses and
telephone numbers of any newly-elected officers within ten (10) calendar
days after such officers are elected.
7. The organization will comply with the “Act for Obtaining a Charter,”
as prescribed by the GPSG Senate.
8. The organization will maintain a copy of its current Constitution
and/or By-Laws on file with the Graduate and Professional Student
Government.
9. The organization will conduct official meetings not fewer than three
times during each of the fall and spring semesters.

Rights conferred by Grant of a Charter
Provided the graduate
student organization fulfills its obligations as set forth in Article II
Section 1 and Section 3, the grant of a charter to a graduate student
organization confers the right to enjoy priority in reserving meeting
space in the Cone University Center in accord with University space
reservation procedures, and the right to use the names UNC Charlotte or
the University of North Carolina at Charlotte in conjunction with the
official name of the organization; provided, however, that such use of
those names shall not constitute a grant authority to the student
organization or to any of its member by virtue of their membership to
have, or to represent themselves as having, authority to act as agent
for, to speak on behalf of, or to obligate, bind or otherwise commit The
University of North Carolina at Charlotte, the Graduate and Professional
Student Senate, or the Graduate and Professional Student Government,
contractually or in any other manner whatsoever. The grant of a charter
also confers the right to apply for funds allocated by the Graduate and
Professional Student Senate, provided that such application shall meet
the requirements of the Financial Procedure Act.

| Section 3 |
Procedure for Re-Chartering (Download
re-chartering form) 1. An officer of the organization
will submit a re-chartering Form by the third Monday in January of each
year, containing the following information.
- Organization’s name, names, addresses and telephone numbers of the
President, Vice-President, Secretary, and Treasurer and the student
identification number of the President and Treasurer (required to expend
funds). The offices of Secretary and Treasurer may be held by the same
person.
- Any changes to the Constitution and/or By-Laws
- Number of members, both graduate and undergraduate
- A list of the events which the organization has participated in or
sponsored that benefited the graduate students in their program or the
UNC Charlotte student population in the previous calendar year.
- A list of goals for the upcoming charter year.
2. Charters must be renewed annually in January to be valid.
3. The organization submitting a charter may be called before a
committee or the GPSG Senate to explain their charter.

Penalties
1. All of the requirements set forth in Article
II, Section 3 must be successfully met in order for a renewed charter to
be granted by Graduate and Professional Student Senate Secretary. A
previously chartered organization found in violation of any requirement
set forth in the “Act for Obtaining a Charter” may lose its charter. The
GPSG Secretary shall send notification to the organization and the
advisor of that organization that it has not been re-chartered.
2. In lieu of revoking an organization’s charter for failure to comply
with the Chartering Act of the Graduate and Professional Student
Government of UNC Charlotte, the Finance Committee of the Graduate and
Professional Student Government may decrease the organization’s proposed
budget for the upcoming charter year. This proposal must be approved by
a majority vote of the Graduate and Professional Student Senate. Once
the Graduate and Professional Student Senate has decreased a club’s
budget, that club may not request additional funds that exceed the
amount they originally proposed.
3. All organizations must submit the Re-chartering Form by the third
Monday in January of each year. If the Re-chartering Form has not been
submitted by the fourth Monday in January, the organization will be
considered an unchartered organization.
